Amazon Is Working around Brands to Obtain Stock—And It’s Legal

Barring issues with compliance, however, there really isn’t much standing in Amazon’s way. The brands could pursue civil actions related to unfair competition or in some cases tortious interference, but even assuming there’s any merit to the cases, brands could end up with nothing in the end, warns Jeff Trexler, attorney and associate director of the Fashion Law Institute at Fordham Law School. “It’s a long multiyear process, which will have ups and downs and appeals and wins and losses, and at a certain point by the time this shakes out, the marketplace will have changed and it will all work itself out anyway,” he said, adding that time is on Amazon’s side. “That’s how you play this as a highly capitalized business.”
