Supreme Court to decide if lethal injection drug is too painful

Deborah Denno quoted in UPI about the Supreme Court’s decision to hear arguments in Glossip v. Gross, and whether the use of midazolam in Oklahoma’s lethal-injection protocols violates the Eighth Amendment to the U.S. Constitution, which bans “cruel and unusual” punishments.

“Even if the court strikes down the use of midazolam and little more, the reverberations throughout the states will be significant,” Deborah Denno, a law professor at Fordham University and an expert on lethal-injection, told the Wall Street Journal. “The simple fact is that states just don’t have other drugs to use.”
