Will the Supreme Court Strike a Lethal Blow to Lethal Injection?

Deborah Denno quoted in the WSJ Law Blog about the Supreme Court’s decision to hear arguments over Oklahoma’s lethal-injection regime, and whether the use of midazolam in lethal-injection protocols violates the Eighth Amendment to the U.S. Constitution, which bans “cruel and unusual” punishments.

But Deborah Denno, a law professor at Fordham University and an expert on lethal-injection, said: “Even if the court strikes down the use of midazolam and little more, the reverberations throughout the states will be significant,” she said. “The simple fact is that states just don’t have other drugs to use.”
