Pennsylvania bills aim to protect students’ data

Joel Reidenberg was quoted in a Pittsburgh Post-Gazette story about proposed Pennsylvania legislation that deals with schools using education technology that includes student data. Under the bill, schools would have to notify parents about such technology and allow them to opt out.

The legislation is “clearly doing a number of very positive things in the current environment of open hunting season on student information,” said Joel Reidenberg, a Fordham Law School professor who wrote a 2013 study on data privacy in public schools. Among other things, it requires vendors to secure information on students and tell districts if it is breached.

He added that the bills contain a few “loopholes” that might be closed through amendments.

Mr. Reidenberg said he’d be “worried about the scenario where [schools]just don’t bother to notify the parents” in spite of the law. The legislation should be amended to allow parents to sue if districts ignore the rule, he said.
