Bruce Green was quoted in a Virginian-Pilot column about an ABA rule that requires prosecutors to disclose proof when they know “of new, credible and material evidence creating a reasonable likelihood that a convicted defendant did not commit an offense.”
Bruce Green, professor at the Fordham University School of Law, helped draft the rule.
“Part of the impetus is the insights from the wrongful conviction cases,” the former federal prosecutor told me Wednesday. “The criminal justice system isn’t perfect.”
Green said some prosecutors willingly pass along new information, while others resist. He said there’s no suggestion of large-scale corruption among prosecutors.
“Some put more weight on the idea of finality,” Green noted.
