Professor Andrew Kent spoke to Bloomberg’s June Grasso about a decision by the Fourth Circuit U.S. Court of Appeals to reconsider a Maryland and D.C. lawsuit accusing President Trump of enriching himself in violation of the U.S. Constitution’s emoluments clauses, in a rare en banc hearing before 15 judges. “I think [the case being reheard]  is significant. Faithful Execution and Article II has been published in the June 2019 Harvard Law Review. The paper is an original historical analysis of the Constitution’s double invocation of the President’s duty of “faithful execution” in the Take Care Clause and the Presidential Oath Clause. Article II of the U.S. Constitution twice imposes a duty of faithful execution on the President, who must “take Care that the Laws be faithfully executed” and take an oath or affirmation to “faithfully execute the Office of President.” These Faithful Execution Clauses are cited often, but their background and original meaning have never been fully explored. On May 20, 2019, Fordham Law School held its 112th diploma ceremony at Fordham University’s Rose Hill campus. Dean Matthew Diller and President Fr. Joseph M. McShane, S.J., conferred degrees on 564 graduates, awarding 386 J.D. degrees, 154 LL.M. degrees, 16 M.S.L. degrees, and 8 S.J.D. degrees. In his welcome remarks, Dean Diller reminded the graduates of the gravity of their chosen profession, noting that they would be entering the workforce at a particularly challenging time, when the responsibility that lawyers bear is at its greatest. Students in Fordham Law’s Democracy and the Constitution Clinic discussed their work with members of Congress and legislative staffers when they traveled to Washington, DC earlier this semester. They met with Representatives Thomas Suozzi, Jerrold Nadler, and Jamie Raskin. Two were once Fordham Law students themselves: Suozzi ‘89 and Nadler ’78. The clinic focuses on developing reforms to strengthen the country’s democratic institutions. While on Capitol Hill, the students highlighted projects dealing with checks on presidential powers, ethics and transparency issues, Electoral College reform, and improving representation in Congress.
